Terms of Service

Welcome to Pepy. These Terms of Service (the “Terms”) govern your use of the Pepymobile application (the “App”) and the website at pepy.app(the “Site,” together with the App, the “Service”), provided by Pepy(“Pepy,” “we,” or “us”). By creating an account, downloading the App, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Important: Tracker-only, not medical advice

Pepy is a tracker. It records the protocol information and calculator values that you choose to enter. It does not recommend doses, dosing frequency, protocol changes, diagnosis, or treatment, and it is not a substitute for professional medical advice, diagnosis, or treatment.

Always seek the advice of a qualified healthcare professional with any questions you may have regarding a medical condition or treatment. Never disregard professional medical advice or delay seeking it because of something you read in or entered into the Service. If you think you may have a medical emergency, call your doctor or local emergency services immediately. Your reliance on anything in the Service is solely at your own risk.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. By using the Service you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

3. Your account

You are responsible for any activity that occurs under your account and for keeping your account credentials confidential. Notify us promptly at info@jhobbie.com if you believe your account has been compromised.

4. Your data

You retain ownership of the information you enter into the Service (“Your Data”). You grant Pepy a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, and display Your Data solely for the purpose of providing and improving the Service.

You are responsible for the accuracy of Your Data. You should keep your own copies of important records.

5. Acceptable use

You agree not to:

  • Use the Service in violation of any law, regulation, or third party right.
  • Use the Service to provide medical advice, diagnose conditions, or recommend doses or treatments to other people.
  • Reverse engineer, decompile, scrape, or attempt to derive source code of the Service except as expressly permitted by law.
  • Interfere with, disrupt, or attempt to gain unauthorized access to the Service, its servers, or related systems.
  • Upload or transmit malware, viruses, or any other harmful code.
  • Use the Service to harass, threaten, or otherwise infringe the rights of others.

6. Intellectual property

The Service, including all software, text, graphics, logos, and other content (excluding Your Data), is owned by Pepy or our licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. All rights not expressly granted are reserved.

7. Subscriptions, billing & refunds

Some features of the Service may be offered on a paid subscription basis. If you purchase a subscription through an app store, billing is handled by that app store and subject to its terms. Unless required by law, payments are non-refundable. You can cancel future renewals through the app store you used to subscribe.

8. Third-party services

The Service may link to or integrate with third-party services. We are not responsible for those services and do not endorse them. Your use of any third-party service is governed by that service’s terms and policies.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT REMINDERS WILL ALWAYS BE DELIVERED. YOU SHOULD NOT RELY ON THE SERVICE AS A LIFE-SAFETY SYSTEM.

Pepy IS NOT A MEDICAL DEVICE. NOTHING IN THE SERVICE IS INTENDED TO DIAGNOSE, TREAT, CURE, OR PREVENT ANY DISEASE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL Pepy OR ITS OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE LIABILITY OR (B) ONE HUNDRED U.S. DOLLARS ($100).

11. Indemnification

You agree to defend, indemnify, and hold harmless Pepyand its affiliates, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any law or third-party right.

12. Termination

You may stop using the Service at any time. We may suspend or terminate your access to the Service at any time, with or without notice, including if we believe you have violated these Terms. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and dispute resolution) will survive.

13. Changes to the Service or these Terms

We may modify the Service or these Terms at any time. If we make material changes to these Terms, we will provide notice (for example, by updating the effective date or notifying you in the App). Your continued use of the Service after the changes take effect constitutes your acceptance of the revised Terms.

14. Governing law & disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws principles. You and Pepy agree to the exclusive jurisdiction of the state and federal courts located in Delaware for any dispute not subject to mandatory arbitration in your jurisdiction.

15. Miscellaneous

These Terms constitute the entire agreement between you and Pepy regarding the Service and supersede any prior agreements. If any provision of these Terms is held unenforceable, the remaining provisions will remain in effect. Our failure to enforce any right or provision is not a waiver of that right.
